This Policy describes how PinoyBiz handles personal data belonging to our clients, our clients' customers, and visitors to our website — in plain language, and in line with Philippine data protection law.
1. Introduction
PinoyBiz ("PinoyBiz", "we", "us") respects your privacy. This Privacy Policy explains how we collect, use, share and protect personal data when you visit our website, enquire about our services, become a client, or use a website or booking page that we build and operate on a client's behalf.
We process personal data in accordance with the Data Privacy Act of 2012 (Republic Act No. 10173) and its implementing rules, as administered by the National Privacy Commission (NPC) of the Philippines.
2. Information We Collect
We collect information in three broad contexts:
- Prospects & clients: your name, business name, email address, phone number, and any details you share with us about your business when you request an audit, sign up for a plan, or contact support.
- Website & booking visitors: when a client's website or booking page is hosted by PinoyBiz, we may process the visitor's name, email, phone number, and appointment details entered at checkout, along with basic technical data such as IP address, browser type and pages viewed.
- Payments: when a booking is paid for, payment is handled directly by GCash and/or PayMongo. We receive confirmation that a payment was made and its amount and reference number, but we do not collect or store full card numbers or GCash account credentials.
3. How We Use Your Information
We use personal data to:
- Provide, operate and maintain websites, Google Business Profile management, booking, and related services;
- Process and confirm appointments and payments, and send related notifications (e.g. booking confirmations, reminders);
- Respond to enquiries, provide customer support, and send service-related communications;
- Prepare invoices, monthly reports, and the free audits offered on our contact page;
- Improve our website and services, and detect or prevent fraud and abuse;
- Comply with legal, tax and regulatory obligations.
4. Cookies & Similar Technologies
Our website and the booking pages we operate for clients may use cookies and similar technologies for essential functions (such as keeping a booking session and its 15-minute slot hold active) and for basic, privacy-respecting analytics that help us understand how pages are used. We do not use cookies to sell personal data to third parties. You can control or disable cookies through your browser settings, though some booking functionality may not work correctly without them.
5. How We Share Your Information
We do not sell personal data. We share personal data only where necessary to run the services described in this Policy, including with:
- Payment processors (GCash, PayMongo) to complete and confirm transactions;
- Cloud hosting, email delivery and infrastructure providers that store or transmit data on our behalf, under confidentiality obligations;
- The business (our client) whose website or booking page a visitor or customer interacts with, since that business needs the booking and contact details to serve its own customer;
- Government authorities, where required by Philippine law, regulation, or a valid legal process.
6. Data Retention
We retain personal data for as long as reasonably necessary to provide the services, satisfy the purposes described in this Policy, and meet our legal, accounting and tax obligations. Booking and transaction records are typically retained for the duration of the client relationship plus a reasonable period afterward, in line with standard bookkeeping requirements under Philippine law. Data is deleted or anonymized once it is no longer needed for these purposes.
7. Data Security
We apply reasonable organizational, physical and technical safeguards — including access controls, encrypted connections, and restricted staff access — appropriate to the sensitivity of the data we hold. No method of transmission or storage is completely secure, and we cannot guarantee absolute security, but we work to minimize risk and to respond promptly to any suspected incident.
8. Your Rights Under the Data Privacy Act
As a data subject under the Data Privacy Act of 2012, you have the right to be informed, to access your personal data, to object to certain processing, to request correction or erasure, to data portability, and to lodge a complaint with the National Privacy Commission. To exercise any of these rights, contact us using the details in Section 11 and we will respond within a reasonable time.
9. Children's Privacy
Our services are intended for business owners and their adult customers. We do not knowingly collect personal data from children, and we ask that booking pages not be used to submit information on behalf of a minor without a parent or guardian's involvement.
10. International Data Transfers
Some of the hosting, email and infrastructure providers we rely on may process data outside the Philippines. Where this occurs, we take reasonable steps to ensure those providers maintain a standard of data protection consistent with the Data Privacy Act of 2012.
11. Changes to This Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or in applicable law. Material changes will be posted on this page with a revised effective date, and, where appropriate, notified to active clients by email.
